Context and Situation

It's late, so please accept my apology if the title might not be the perfect way to explain this

Some of you already have seen video, but if not it's a fun exercise.

Context is a public place with other citizens, with a person harassing a government employee

Situation leads to both people swearing/insulting each other, with the person eventually throwing a punch at the public worker. Public worker gives her one final warning, walks up and fights back. Neither person has serious injuries and both continue to talk to each other after being seperated

Before you watch the video, write down your answers to the following

1) Who is at fault
2) Who should be charged
3) What should be the punishment

My initial thoughts below

Yes female being attacked by a male, both of African decent. I don't think this effects anything legally, but socially we would be ignorant to say otherwise.

Personally, I think the driver should keep his job. After being sent to anger management courses and community service.

Citizen should be banned from public transport for 1 year.

Both should be given fines of some sorts.

Yes they both attached each other, but the video doesn't give us the entire story. We don't know the cause of it, and clearly the women was more then willing to instigate the issue. Considering the courts are asked to consider what a rational human being should do, it's not hard to consider the driver being pushed beyond his limits. He did use excessive force, but without any serious lasting harm issued.

Also, "You wanna be a man, I'll treat you like a man" -> Quote of the year

I'll give some more verbose thoughts on the video later. Maybe post some more later this weekend.
